These general conditions govern the sale of the products marketed by the website www.risalti.it/en owned by:

B - How to purchase


The purchase is made through access and registration to the site risalti.it. Only the products available at the time of consultation can be purchased unless otherwise indicated in the product information. risalti.it reserves the right to modify the characteristics of the individual product, also to adapt it to the manufacturer's specifications, without prior notice.
The proposed images may not be perfectly representative of the product and may differ significantly in colour.


Once the product has been displayed, it will be possible to add it to the cart and, in the following windows, confirm the purchase after verifying and confirming the characteristics, price, shipping methods and costs. Once the real availability of the ordered product has been verified, risalti.it will issue an acceptance of the order through a self-generated e-mail summarizing the characteristics, price and general and particular conditions of sale applied to the product. This communication will also contain an "order number"


In the event of non-acceptance of the order by risalti.it, the company will undertake to promptly notify the Customer.

The Customer has the right to cancel the order until it is processed by the warehouse and, therefore, prepared for shipment.


All prices on the site are inclusive of VAT. The company reserves the right to change them at any time, without prior notice or notification. In the event that the sale price is incorrect and / or manifestly unreal due to an error, the order will be cancelled even if confirmed and the Customer refunded the amount paid.


Invoice :

If the customer needs an invoice, it will be necessary to request the issuance of the same at the same time as the purchase, entering the request in the notes field during the choice of the shipping method, together with the billing data. The invoice will be attached to the shipment.


It will not be possible to issue an invoice after the order has been processed..

C – Conclusion of the Contract


The amount of purchases will be calculated on the sum of the cost of all the items you intend to purchase, including VAT, net of shipping costs or any other additional costs communicated at the time of order.


By selecting the "Send the order" button during the purchase process, the buyer declares to fully and unreservedly accept all of these General Conditions of Sale.


risalti.it will confirm the order by sending an e-mail.

risalti.it reserves the right to change its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of placing orders.


The products remain the property of the supplier until the total settlement of the amount due.

D - Payment methods

The following forms of payment are accepted by risalti.it:

1. Credit card
The purchase by credit card is made through the Sinergia Payway payment gateway. The credit cards accepted are all those that rely on the Visa, Mastercard and American Express circuits.
At no time during the purchase procedure is risalti.it able to know the information relating to the buyer's credit card, as they are typed directly on the website of the bank that manages the transaction. Since there is no data transmission, there is no possibility that this data will be intercepted. No computer archive of risalti.it contains, nor does it keep, such data. In no case can risalti.it therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment of products purchased on www.risalti.it/en.

2. PayPal
In case of purchase through the PayPal payment method, at the conclusion of the order, the Customer is directed to the login page of PayPal. The amount related to the order is debited from the PayPal account at the time of acquisition of the order. In case of cancellation of the order, both by the Customer and in the case of non-acceptance of risalti.it, the amount will be refunded to the Customer's PayPal account. The cancellation of the order is possible until the moment in which the same is not yet being prepared in the stock warehouse. Once cancellation of the transaction has been requested, in no case can risalti.it be held responsible for any damages, direct or indirect, caused by delay in the non-release of the amount committed by PayPal. At no time during the purchase procedure is risalti.it able to know the Customer's financial information. Since there is no data transmission, there is no possibility that this data will be intercepted. No computer archive of risalti.it contains, nor does it keep, such data. For each transaction made with the PayPal account the Customer will receive a confirmation e-mail from PayPal.

E - Delivery Terms and Conditions

risalti.it/en can accept orders with delivery in the territory of the Italian state. Orders are usually processed within 48 hours of the order.

Delivery is made by Express Courier at the shipping cost indicated on the screen during the completion of the order.
The cost of shipping is charged to the buyer, according to the rates and costs indicated. Each delivery is considered completed from the moment the carrier makes the products available to the buyer, as resulting from the system used by the carrier to track shipments. It is the responsibility of the recipient to verify the products at the time of delivery and to raise any reservations and complaints that appear justified, including the possibility of refusing the package or receiving the goods with "Reserved right to verify".

No responsibility can be attributed to risalti.it in case of delay in the execution of the order or in the delivery of the ordered goods.

Upon delivery of the goods by the courier, the Customer is required to check:

- that the number of packages delivered corresponds to what is indicated in the bill or transport document (DDT);
- that the packaging is intact, not damaged, nor wet or, in any case, altered.

It is the responsibility of the recipient to verify the products at the time of delivery and to raise any reservations and complaints that appear justified. Any external damage or mismatch in the number of packages must be immediately reported to the courier who makes the delivery, affixing the words "withdrawal with reserve for damaged package", or "withdrawal with reserve for open package" or "withdrawal with reserve for missing packages" on the appropriate accompanying document.

F - Shipping costs

the products of risalti.it are shipped by Express Courier. Shipping on the Italian territory has a cost of € 6.90 (VAT included) and is free for orders of an amount over € 49.90. Standard delivery is usually within 1-2 working days.

The costs indicated are valid for the entire Italian territory (including the islands).

G - Right of withdrawal / Returns and Refunds

In compliance with the provisions of the Consumer Code - Legislative Decree 206/2005, , the Customer has the right to withdraw from the purchase contract, without providing any reason and without any penalty.

The maximum period within which to send the intention to exercise this right is 14 days from the day of receipt of the goods by the consignee or by a third party designated by the latter. The procedures for exercising this right will be expressed in the following paragraphs.


The shipment of the returned goods must take place within 14 days following the communication of withdrawal by the Customer (after which the right will be considered forfeited) to the following address attaching a copy of the order: KATIA S.R.L. - Via C. The burden and responsibility of the return shipment is to be borne by the Customer until it is received by risalti.it. It will be the seller's responsibility to report the receipt of goods damaged during transport to the Customer who can claim against the courier for such damage. risalti.it, in this case, will make the goods available to the Customer by cancelling the withdrawal procedure.

Once risalti.it has received the goods, the Customer will be reimbursed for the amount paid except for additional expenses beyond those provided for by the basic shipping rate, to which risalti.it is not required to respond in case of withdrawal.


The right of withdrawal lapses in case of substantial defect of the returned product (original packaging not intact or missing, damage, unsuitable state of return, obvious signs of wear and / or carelessness) and in the cases previously set out.


In case of forfeiture of the right of withdrawal risalti.it will return the goods to the Customer who will not be entitled to any refund.


To exercise the right of withdrawal, the Customer is required to notify risalti.it preferably by email to: servizioclienti@risalti.it/en.

H - Returns and Refunds

If for any reason the customer is not satisfied with their purchase, unworn items can be returned for exchange of size / colour or Refund within 28 days from the date of receipt of the goods. The safety thread on the items to be returned must not be cut or broken.

Return instructions

To request permission to make the return, you must contact us by sending an e-mail to servizioclienti@risalti.it indicating:

  • Name and Surname, e-mail
  • The number and date of your order
  • Items to be returned

risalti.it  will send a confirmation by e-mail containing the return authorization, the customer must take charge of the return shipment by courier or mail, to their liking. When Risalti receives the returned item and has verified the good condition of the same, it will make the refund. The return shipment must take place within 28 days of receipt of the order.

There are 2 types of compensation available:


Exchange for Size or Colour

It is possible to make the change for a different size or a different colour of the same item, if available. The new garment requested can be returned following the same procedure


Refund


The refund will be made as soon as the returned items arrive and are verified at the warehouses of risalti.it For orders paid by Credit Card the amount refunded will be available to customers in about 10 days, and will be visible on the next card statement. The timing may vary depending on the banking circuit of the Credit Card used.
For orders paid with PayPal, the amount will be returned to the original account. Any differences in amount due to exchange rate fluctuations cannot be refunded. Any cost originally incurred for the shipment of the order will be refunded to the customer only if all the items purchased are returned

Terms and conditions of returns:

  • The safety thread on the returned items must not be cut or broken. The garments must not have been washed or altered and must not show any signs of use
  • Each item must be returned with all labels and tags attached, and including all original packaging and accessories received with the order.
  • In the event that the customer receives defective goods, or that errors occur in shipments that are attributable to risalti.it, the customer is invited to immediately contact: servizioclienti@risalti.it
  • risalti.it si riserva il diritto di richiedere prove fotografiche prima di autorizzare resi per merce difettosa e farsi carico delle spese di spedizione per il rientro della merce presso la propria sede. 
  • I resi autorizzati da risalti.it devono essere spediti dalla stessa nazione in cui l’ordine originario è stato consegnato.
  • risalti.it reserves the right to request photographic evidence before authorizing returns for defective goods and bear the shipping costs for the return of the goods to its headquarters.
  • risalti.it reserves the right not to accept returns shipped with couriers other than the one indicated in the e-mail with the return instructions if the delivery involves additional costs for risalti.it or requires collection at a branch of the courier itself. also reserves the right to refuse returns that are not authorized or otherwise do not comply with all the conditions provided. In these cases the goods will be returned to the sender at the original shipping address. Any acceptance of such returns will still involve a charge equal to 10% of the value of the returned goods.
  • For all aspects not specifically expressed, the European legislation for distance trading prevails.

I - Warranty and lack of Conformity


All products, except for perishable or consumable products, are covered by a legal guarantee of 12 months.



The Customer has the right to restore or replace the Product at his choice or, secondly, to an adequate refund of the price or to the termination of the contract unless one of the possibilities is impossible or excessively burdensome for risalti.it in comparison to another.


The right lapses in the event that the Customer does not report the lack of conformity within two months from the date on which the defect manifests itself except in the case in which the product is perishable or expires in a shorter time, in which case the complaint must be made within such times.


The warranty is void in any case in the event that:

  • the defects are due (in whole or in part) to misuse, improper use or storage or maintenance or non-compliance with the instructions provided by the manufacturer;
  • at the time of conclusion of the Contract, the Customer was aware of the defect and could not ignore it;
  • the lack of conformity derives from instructions or materials provided by the Customer.

L - Processing of personal data

The personal data requested during the placing of the order is collected by risalti.it and processed on computer media, in order to satisfy the obligations arising from the contract concluded with the Customer and will not be in any case and for any reason transferred to third parties.
risalti.it guarantees its customers compliance to the legislation on the processing of personal data, governed by the New General Regulation on the Protection of Personal Data GDPR, European Regulation 679/2016.

M - Applicable law

The sales contract between the Customer and risalti.it is concluded in Italy and governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Mantua.
Consumers resident in the EU can use the Online Dispute Resolution tool to file a complaint when they encounter problems with an online purchase.
The parties have 90 days to communicate via the platform and reach a mutually satisfactory agreement. If this does not happen, the consumer has 30 days to contact a neutral and authorized Alternative Dispute Resolution (ADR) body to resolve the case.
Consumers can also decide to contact a third party immediately, without waiting for the deadlines to expire.
